The Happy House - Terms and Conditions

Welcome to The Happy House. These Terms and Conditions (“Terms”) govern your access to and use of the demo version of The Happy House application (“Demo”), including any related website, dashboard, games, and well-being activities.

By accessing or using the Demo, you agree to comply with and be legally bound by these Terms.


1. Introduction

The Happy House Demo is designed to nurture young minds through calm, well-being, and engaging game-based activities. These Terms apply to all Schools, educators, administrators, and authorised users accessing the Demo or any associated School Subscription services.


2. Purpose of the Demo

The Demo is provided solely for evaluation and demonstration purposes.

It showcases selected activities and games informed by neuroscience and behavioural science principles intended to support primary school-aged children, including those affected by Autism, ADHD, or other conditions impacting emotional regulation and focus.

The Demo does not constitute medical, psychological, or therapeutic advice.


3. Access and Permitted Use

Access to the Demo:

  • Is granted for a limited time at the discretion of The Happy House team.
  • Is non-transferable and revocable.
  • Must not be used for commercial exploitation.

Users must not:

  • Copy, reproduce, distribute, modify, or reverse engineer any part of the Demo.
  • Remove branding, copyright notices, or proprietary markings.
  • Use the Demo in a manner that infringes intellectual property rights.

The Demo is provided on an “as-is” and “as-available” basis without warranties of any kind.


4. Limitations of the Demo

  • The Demo may not include all features or functionality of the full application.
  • Performance and availability may vary.
  • Features may change without notice.
  • Access may be discontinued at any time.


5. Privacy and Data Handling

Any personal information entered into the Demo or School Dashboard will be handled in accordance with:

  • Applicable Australian privacy laws, including the Privacy Act 1988 (Cth), and
  • The Happy House Privacy Policy.

Schools are responsible for ensuring they have appropriate consent to enter student information into the platform.

Users should avoid entering unnecessary sensitive information during Demo evaluation.


6. Intellectual Property

All software, content, design elements, branding, games, well-being activities, dashboards, reports, and materials remain the exclusive intellectual property of The Happy House and its creators.

Access to the Demo does not grant ownership rights or licence beyond permitted use for evaluation or subscription purposes.


7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or other applicable legislation that cannot be lawfully excluded.

To the extent permitted by law, liability for breach of any non-excludable guarantee is limited to the resupply of services.


8. Limitation of Liability

To the maximum extent permitted by law:

  • The Happy House and Youth Dimension are not liable for indirect, incidental, or consequential loss.
  • We are not responsible for interruptions, system errors, or data loss arising from Demo use.
  • Users access and use the Demo at their own discretion and risk.


9. Termination

Access to the Demo may be suspended or terminated at any time without notice.

We reserve the right to revoke access if these Terms are breached.


10. School Subscription Terms


10.1 Subscription Commencement

If your School subscribes to The Happy House Subscription, you will receive access to:

  • The School Dashboard
  • Well-being games and activities
  • Associated subscription features

Access commences on the subscription start date.

Subscriptions are billed automatically to the nominated payment method provided at purchase.


10.2 Ongoing Billing

Subscriptions operate on a recurring billing cycle and continue until cancelled.

Schools have full control over subscription management via the School Dashboard.

To cancel:

  1. Log in to your School Dashboard
  2. Select “Manage Subscription”
  3. Click “Cancel Subscription”

Billing will cease at the end of the current billing period.

If cancellation occurs before the billing period ends, access to well-being games and activities will remain active until that period concludes.


10.3 Access After Cancellation

Once the billing period ends:

  • Access to well-being games and activities will cease.
  • Schools will retain access to their Happy House School Dashboard.

Dashboard access after cancellation allows Schools to:

  • View expired billing history
  • Access past invoices and receipts
  • Access their School account setup, including configured Year levels and classes

Schools may log in at any time and elect to re-subscribe.


10.4 Re-Subscription

Upon re-subscription:

  • A new subscription cycle will commence.
  • Historical billing records from previous subscriptions will no longer be accessible.
  • Billing history displayed will relate only to the active subscription period.


10.5 Subscription Responsibility

Subscription management is self-service within the School Dashboard.

Youth Dimension:

  • Does not have access to Schools’ personal billing data.
  • Cannot cancel subscriptions on behalf of Schools.
  • Is not responsible for notifying Schools when a subscription has been cancelled.


11. Data Retention

Upon cancellation of subscription access to well-being games and activities, data relating to active subscription features may no longer be accessible.

Schools are responsible for downloading or exporting any necessary data prior to cancellation where functionality permits.


12. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of Victoria.


13. Changes to These Terms

The Happy House may update these Terms from time to time.

Updated Terms will be published on the website and take effect from the stated Effective Date.

Continued use of the Demo or Subscription services constitutes acceptance of updated Terms.
